These Terms of Use ("Terms") govern your use of jamailhardwoods.com (the "Site") operated by Jamail Hardwoods, LLC ("Jamail Hardwoods," "we," "our"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
You may browse the Site, download spec sheets and PDFs we publish, and submit inquiry forms. You may not:
Jamail Hardwoods is a business-to-business (B2B) trade supplier. We do not sell directly to homeowners or end-consumers through this Site. Quotes and trade pricing are available only to qualified trade professionals (interior designers, home builders, architects, project managers, developers) who have been approved for a trade account. Approval is at our discretion.
Quotes provided through the Site, by email, or by phone are estimates valid for 30 days unless otherwise stated. An order is only binding when (a) we have provided a written acknowledgment and (b) we have received the agreed deposit (if applicable). All orders are subject to our then-current standard sales terms, which will be provided with your order acknowledgment.
Downloads on the Site (CSI specs, technical data sheets, CAD blocks, Revit families, care guides) are provided "as is" for use in good-faith project specification. You may incorporate them into your project documentation. You may not redistribute them as standalone files outside the context of a project.
Sample template language in our downloadable spec sheets is provided for your reference. You are responsible for verifying that final project specifications match the actual materials we will supply — final specs should always be confirmed in writing with your Jamail rep before issuing.
All content on the Site — including the Jamail Hardwoods name, logo, photography, copy, layout, code, and downloadable materials — is the property of Jamail Hardwoods, LLC or its licensors and is protected by U.S. and international copyright and trademark law. Limited download rights are granted only for the purposes described in Section 5.
The Site may link to third-party sites (LinkedIn, Houzz, Yelp, Instagram, Facebook, X, the GitHub repo where we store team photos). We are not responsible for the content, accuracy, or practices of those sites. Linking is for convenience and does not imply endorsement.
The Site is provided "as is" without warranties of any kind, express or implied. We make commercially reasonable efforts to ensure information on the Site is accurate, but we do not warrant that the Site will be error-free, uninterrupted, or virus-free. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Jamail Hardwoods, LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim related to the Site shall not exceed one hundred U.S. dollars ($100).
This limitation does not apply to product liability, breach of warranty, or other claims arising from actual sales transactions, which are governed by our standard sales terms.
You agree to indemnify and hold harmless Jamail Hardwoods, LLC and its employees, officers, and representatives from any claim arising out of your misuse of the Site or violation of these Terms.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms shall be resolved in the state or federal courts located in Harris County, Texas.
We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised Terms.
